The information provided on italianamericans.com (the “Site”) by The Alghini Institute for Italian Americans (“we,” “us,” or “our”) is for general informational, educational, and cultural purposes only. All information on the Site is provided in good faith; however, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site.

Under no circumstance shall we have any liability to you for any loss or damage of any kind incurred as a result of the use of the Site or reliance on any information provided on the Site. Your use of the Site and reliance on any information on the Site is solely at your own risk.

Fair Use Disclaimer — Historical Archives & Educational Content

This site contains copyrighted material the use of which has not always been specifically authorized by the copyright owner. We make such material available in the context of our nonprofit educational mission to document, preserve, and teach Italian American history and cultural heritage.

The Alghini Institute maintains a digital archive of historical documents, photographs, oral-history recordings, newspaper clippings, immigration records, and publications as part of its 501(c)(3) educational mission to preserve Italian American heritage. Some of this archival material may be protected by copyright.

We believe this constitutes a “fair use” of any such copyrighted material as provided for in Section 107 of the United States Copyright Act (17 U.S.C. § 107), which states:

“The fair use of a copyrighted work, including such use by reproduction in copies… for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.”

In determining whether our use of copyrighted material qualifies as fair use, we consider all four statutory factors:

  1. Purpose and character of the use — Our use is nonprofit, educational, and transformative. Material is presented with scholarly commentary, historical context, and educational framing to advance public understanding of Italian American history.
  2. Nature of the copyrighted work — Archival materials are primarily factual and historical in nature, which favors fair use.
  3. Amount used — We use only the portions reasonably necessary for educational commentary and historical documentation.
  4. Effect on the market — Our nonprofit educational use does not serve as a substitute for the original works and does not diminish their commercial value.

If you wish to use copyrighted material from this Site for purposes of your own that go beyond fair use, you must obtain permission from the copyright owner.
